Terms and Conditions
Please read carefully
If you are unhappy with our service or have a complaint please read our complaint proceedure information. These terms and conditions will apply to all transactions placed online, by e-mail, telephone or by post with 54 Degrees-North. Please read carefully before placing an order. Nothing in these terms and conditions will affect your statutory rights. All references to 'us', 'we' or the 'company' refer to 54 Degrees-North. 'You' or the 'customer' refers to the person responsible for placing the order. By placing an order with 54 Degrees-North. you are agreeing to these terms and conditions. Orders: We will accept orders via telephone, online transaction, e-mail and post. We accept MasterCard, Visa, Delta, Switch and Solo but cannot process American Express or swipe only cards such as Electron. If the card issuer refuses to authorise payment we will not be liable for any delay and/or non-delivery of the order. No orders will be accepted without a valid card payment in the name of the registered cardholder and its registered address. Cheques/postal orders must be made payable to 54 Degrees-North. we reserve the right to hold goods until the cheque/postal order has cleared. Therefore we do not dispatch goods within three working days if payment is via cheque/postal order. Damaged Items And Delivery Mistakes: In the event of any goods being delivered faulty, damaged in transit or incorrect according to the delivery note/invoice then we must be notified within 7 working days of receipt. If we receive no notification the customer will be deemed to have accepted the items as satisfactory. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the courier company. Liability in those cases is limited to the value of those items, which are shown not to have been received by the customer. We are unable to refund any postage costs unless the item was sent in error or damaged upon delivery, in these cases the credit card used will be credited with the current price of postage according to the Royal Mail's tariff Please see Returns & Exchanges for more information or call 01833 631934 Delivery: Europe Delivery Costs:
Items ordered will be delivered as soon as possible and we aim to process and dispatch each order within 3 working days of receipt via either Royal Mail, Initial Citylink, Business Post. Although you can have the goods delivered to any address within the U.K. we recommend that there be someone to sign for the goods upon delivery to speed up the delivery time and avoid any delays. We reserve the right to deliver the goods to the cardholders address. We regret to say that there is a £10.00 surcharge should the parcel need to be re-routed to a different address once it has been despatched.We reserve the right to change the delivery prices without prior notice. While we make every effort to ensure that delivery takes place within three working days on items that are currently in stock, we cannot guarantee any delivery times. In the event that we cannot deliver your order or a part of your order we will inform you within three working days. Only orders under 25 kilos can be sent to these destinations. We reserve the right to cancel any orders placed which do not comply with these terms. Orders for the Channel Islands are inclusive of VAT. Please note: that any order returned to us due to failed delivery where our couriers have attempted delivery and left contact cards, then received no reply from the customer, will be charged a flat rate of £5.00 restocking fee, whether the customer requests the order to be resent or cancelled. This also applies to orders cancelled once despatched. Distance Selling Regulations: As a mail order customer you have the right to cancel any item within 7 days of delivery (excludes perishable items, personalised items or items where we will have discussed the goods and you have agreed to take them. I.E. Special orders) provided they are in new and unused condition with original packaging and receipt. Items used will be deemed to have been accepted by you and therefore cannot be returned unless faulty. To cancel an item please call or e-mail us. Items must be received by us within 7 days of cancellation and you will receive a full refund to your credit card upon inspection of the goods ( See restocking Fee ). We will not refund your postage costs unless the item is faulty or there is an error in the delivery. Price and Print Errors: Whilst we make every effort to ensure that all details published are correct no responsibility will be accepted for errors and omissions. We reserve the right to alter specifications and prices without notice. Prices: All prices are shown in pound sterling (£) and include UK VAT unless clearly stated otherwise (I.E. Channel Islands and some BFPO addresses.) All prices are subject to change without prior notice. Products: Products are sold singly unless otherwise stated and although we make every effort to ensure that we have stock we cannot guarantee that every item on the online shop is in stock. Please call 01833 631934 for stock availability if you need the product in a short space of time. Should products be out of stock you will be e-mailed within three working days. (Please ensure that your e-mail is correct when placing the order.) Every effort is also made to ensure that the colours listed and picture on the site are accurate but due to technical limitations some colours may vary. Shopping is Safe at 54 Degrees-North: Shopping is safe with 54Degrees-North because all details are sent using encrypted software. This means that the credit card details sent are coded in such a way that, in the extremely unlikely event that someone is somehow able to obtain this information, only we can decode the information to obtain your credit card details. The credit card details are encrypted on your PC through the "encryption" page and they are only decrypted after they reach our computer. They are not held in clear text on any web site. The method used is 128-bit encryption. Please note that none of our customers has ever reported to us fraudulent use of their credit card as a result of shopping with 54 Degrees-North. Returns & Exchanges: We want you to be 100% satisfied with any and every order placed with us. Therefore if you wish to return an item for any reason at all you may do so within at any time up to 7 days from receipt of the goods. To return a non-faulty item the product must be in its original condition with the original labels attached and a copy of the invoice, once an item has been worn or used we will be unable to refund or exchange unless the item is found by the manufacturer to have a fault. Should an item be returned with no fault but in a used condition we will return it to the customer. In the event of wanting to return a non-faulty item we must be informed before its return via e-mail or telephone/fax within 14 days of receipt and informed as to why the goods are being returned and whether you want a refund or an exchange. The products must reach us within a further 7 days from notification and you will be refunded/exchanged as soon as we receive the garment and upon inspection to ensure that it is in its original condition.
